    Hello all:

    First, I'd like to express my thanks to IV for taking up this cause and doing a wonderful job!

    I am currently on an H1-B visa. My 6 year term expires 2/1/09. Current employer is yet to file LCA. Company lawyers have advised that any time I've spent out of the country (past & within next few months) can be used to offset the 1-yr cut off requirement for LCA application. I've been out for a total of 6 weeks to date, but would need more time, looking at an April-end LCA filing. I am now looking to change my job.

    -Can I change my status to H4 until I get another job and then file for GC with new employer?
    -What are current processing times for H4 if applied from within the US?
    -Will I get subjected to H1 quota when changing back from H4 to H1?
    -I've been told time spent on H4 is not counted for H1 term and I can apply that time (in addition to my 6 weeks) to the 1-yr limit (LCA should be filed 1 yr before 6-year H1 expiration). Is this true?
    -If so, what about the time taken for H4 approval? Can I be in status after resigning & while waiting for H4 approval? Can the time taken for H4 approval be counted towards time not on an H1?
    -Has anyone heard of such a situation? What are the chances of getting an extension if H1 ported to new company & LCA filed with them after joining?

    Any input is greatly appreciated.

    Guys,
    I spoke to another Border Post official and he suggested that i drive uptp the nearest border and they would refuse my entry to Canada as i don't have a valid visa and i can turn around and come back to US and i can get a new I-94. Do you think it would be safe to do this ?
    Any advices?

    You will not get new I-94 for travel to Canada less than 30 days.

    What visa status are you in? If you are on H1, your H1 renewal will have the new valid I-94.

    I got to use one of Gary Parr's "Kata" brand covers recently. They are quite nice and more importantly, they get the job done. Just a bit tough to put on but that probably isn't an issue with some practice.

    The Kata consists of one part to cover the camera (and your hands), the other is a lens cover (these are interchangable - different sized for different-sized lenses).

    I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.

    Will be a problem if they notice, hopefully they will overlook this. As per the Law you have to be on the payroll at all times unless the company has granted you unpaid leave for a very valid reason such as medical emergency etc.

    My wife is currently in the US on H4 Status and she is taking classes at a local university on a part time basis.

    We are planning to go for our visa revalidation next month.

    How should i answer DS 156 Question #33.Do you intend to study in the US? for my wife?

    I think i should answer yes since she will continue taking classes after we come back to the US. Will this be an issue since she is on H4?

    For filing of I485, do I need to file for my dependent child who is an US citizen (age :1 year+)? Also does my child need to go through the medical exam and be part of the I485 application even though she is a citizen?
    Sometimes it becomes confusing and some guidance from our IV folks is really appreciated.

    Following is the situation:

    My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
    Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
    Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).

    Falling short of 10 weeks to get the 365 days rule

    Options that I learnt for me getting 7th yr extension and staying in the country:

    Option1:
    Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
    File for 7th year extension based on the 365 days rule
    Convert from H4 to H1 and start working.

    Option 2:

    Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
    File for 7th year extension based on the 365 days rule
    Stamping in canada to return to USA.
    (I am hoping 7th year extension can be done while I am outside the country)

    Option 3:

    Go back to India for 3 months wait till June 20th,
    File for 7th year extension based on the 365 days rule
    Stamping in India to return to USA.
    (I am hoping 7th year extension can be done while I am outside the country)


    Option 4:

    Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

    Can the gurus/experts please put in any issues I might be running into or if any of the option above are not at all feasible(may be I am ignorant)

    Folks,

    The "Time as Resident in a USCIS District" clause in the naturalization process says that "Most people must live in the USCIS District or State in which they are applying for at least 3 months before applying".

    If you have gone thru this process could you please tell if this means that
    a. the person must have stayed for at least 3 months during any time during of the residency period to be eligible to apply in that district

    OR,

    b. the person must live in the district for at least 3 months immediately preceding the naturalization application (for example, if applying in July 2010 then must be present in that state/district at least since Apr 2010)

    The reason I'm asking is that I know people who live in India after GC and then come return to get citizenship...so wondering how it worked...
