certainly there is a possibility for delay with pretty much anything that involves immigration. when does your current H1 expire? Even if it expires since you have a pending application, the reciept notice would possibly suffice to continue in legal status. I am definitely not an expert. Others might provide better idea.

Your priority date is the same as your husband's. It will be on your husband's I-140 approval notice.

I worked on an L1b in the US for 4 years. Because my company wouldn't sponsor me for a green card, I decided to switch to another company that offered to sponsor me for permanent residency and employ me in Europe in the meantime. Unfortunately, the PERM was audited and the legal entity that applied for the PERM is being dismantled as the result of an acqusition.
As a next step, the company could sponsor me for an L1 (not sure if L1a is possible, otherwise L1b) or an H1, but it's unlikely they'll sponsor me again for a green card soon. I also have an offer from another company, who'd offer to sponsor me for an H1 and possibly for a green card later on.
Since my spouse has a green card (same sex couple, therefore no family green card possible), I would very much like to return to my home in the U.S.
Which one is the safer option - L1x + H1 or H1 + green card? I have two bachelor degrees and 13 years of specialized experience but no masters degree. Any other advice for my situation?

I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.

My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

1. "What is Date for Application?" - is the "Received Date" in my EAD receipt?
2. "Manner of Last Entry" : I put H1B - Speciality Occupation. Hope that is fine as I entered last year using H1B (am on H1B and there was one more H1 option there)

I am from PA. I am a June filer. My wife who is a primary applicant, got EAD for her and our son in the first week of Aug(after finger printing). I did not get my EAD so far. I had been to Philadelphia after getting INFOPASS appointment last week. Nothing happened there, just waste of time! It seems that there are no rules/ regulations in this system. Many of my friends got their EAD before FP. One of my friends got his GC without I-140 approval. The whole GC system is in big mess.

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.

If EB2, then you are in a better position alteast compared to many folks here.. The PD for Mar '06 per DOS, Visa Bulletin, for EB2 is 01JAN02, Since your case has a PD of Jan 02, (Date not provided by you),

I have been a student at a university, and while an application for permanent residency I had to show/combine my income (student teaching/research assistantship) in I-864 because my spouse's income was not sufficient to sponsor me. In form I-864 instructions it says, "Intending immigrant is your spouse, his/her income can be used to combine with your income if his/her income will continue from the same source after receiving lawful permanent residency." Now, my question is that I have an offer of admission from other school, and this new school will pay me student teaching/research assistantship, can I leave my current school and join the new one? If not, how long I have to wait in order to have right to change my school?
Secondly, can my spouse leave her job and sit idle? I ask this because my spouse sponsored me in I-864, and I wonder until when she is supposed to continue her current job!
Please advise me your best to help me with my doubts. I will be obliged!

Any idea with whats going on with TSC Processing times, my PD is current Nov' 2003, however do not see any movement in the processing times, 485 applied on Aug 7, 007, any idea when they will publish the new processing times? Any way we can know where we are in the 485 proccess?

IV seems to have a lot of folks here on a h1b with a non profit organization. My wife is currently doing her residency in a non profit organization on a h1b so basically she is not subject to the cap.
After she finishes, and she looks for jobs, is it possible to get a h1b transfer in a profit organization without being subject to cap? Or H1b transfer is possible only with an non profit organization.
Any inputs will be well appreciated.
